法定性別

性別自我認定應用於法定性別；除部分國家外，上文所列是以國家為單位進行區分，故而在行政區劃層級上未予標註。美國的部分州呈紅色顯示，原因在於該國法律因州而異。例如，德克薩斯州等灰色區域的州明確禁止未經手術的法定性別變更。[1]

法定性別（英語：Legal gender），亦稱為法律性別，係指法律所認可的社會性別或者生理性別。法律性別的確定通常涉及生物性別、性別重新決定以及性別認同等因素，具體情況因司法管轄區域的不同而有所差異。法律層面的性別身份對許多法律權利與義務具有基礎性作用，包括獲得醫療服務、工作權利、家庭關係，以及個人身份識別和證件相關的問題。儘管其基本原則看似較為簡單，但確定法律性別卻極為複雜，充分彰顯了生物特徵、自我認同的性別認同、社會規範以及不斷演變的法律標準之間的動態交互作用。鑑於此，法律性別研究屬於一個複雜的領域，受到文化、歷史以及法律等諸多因素的影響。故而，有必要展開全面深入的探討，以便充分理解該主題在一系列法律體系以及社會中的影響和範疇。

歷史

在歐洲社會中，羅馬法、後古典時期的教會法以及後來的普通法將人的性別劃分為男性、女性或雌雄同體。其擁有法律權利則根據外表上最為顯著的性別特徵確定為男性或女性。根據羅馬法，雌雄同體必須被歸類為男性或女性。[2]12 世紀的《格拉提安教令集》規定：「雌雄同體的人作為遺囑見證人，取決於哪一種性別佔優勢。」[3][4][5]作為普通法的基礎，16 世紀的《英格蘭法律原理》描述了雌雄同體可根據「佔優勢的性別」繼承財產，無論是以男性還是女性的身份。[6][7]幾個世紀以來，曾經有法律案件涉及法律性別的疑義而被記載下來。

1930 年，莉莉·艾爾伯接受了性別重置手術及卵巢移植，並將她的法定性別改為女性 。 1931年，朵拉·里希特接受了陰莖切除術和陰道成形術。數周后，莉莉·艾爾伯進行了最終手術，包括子宮移植和陰道成形術。然而，因移植的子宮引發的免疫排斥反應，致使她不幸離世。1933 年 5 月，性學研究所遭到納粹襲擊，關於里希特的任何現存記錄均被損毀。[來源請求]

托尼·艾貝爾（Toni Ebel）和她的伴侶夏洛特·夏拉克（Charlotte Charlaque），兩人皆是德國接受過性別重置手術的案例，但於1942年因鄰居的騷擾被迫分居。[8]

第二次世界大戰結束後，跨性別議題再次受到公眾關注。 1950年代和60年代的立法主要集中在將同性戀定為犯罪並強化異性戀規範的性別角色，導致不符合性別規範的個體遭受不成比例的警察騷擾和逮捕。克里斯汀·喬根森（Christine Jorgensen）因其出生證明上標示為男性，無法與一名男性締結婚姻關係。部分跨性別者對自己的出生證明進行了更改，然而這些文件的合法性常常遭到質疑。在英國，尤恩·福布斯爵士（Sir Ewan Forbes）的案件承認了法律性別變更的進程，但在 Corbett v Corbett 案中，法律性別變更並未獲得承認。1969年的石牆暴動是同性戀權利運動的關鍵節點，這一事件引發了全球範圍內的抗議活動與遊行，同時凸顯了 LGBT 群體持續面臨的歧視與暴力問題。[來源請求]
